New York Medical Malpractice Lawyers at Fitzgerald & Fitzgerald Settle Birth Injury Lawsuit for $4,000,000.00

Specifically, this New York medical malpractice lawsuit was filed in Kings County Supreme Court against the defendant, Kings County Hospital Center. The case was assigned a case number of A07157 and it was filed because the plaintiff infant had allegedly suffered brain damage, developmental delays, severe cognitive delays, seizures and a loss of hearing as a result of the actions of the defendant.

The court documents relating to the case allege that the day before the plaintiff infant was born, the mother reported to the defendant hospital and complained of light contractions and bleeding. When the mother was put under observation, she allegedly told the nurse that she had Guillain-Barre syndrome. 

Approximately 90 minutes later, a different nurse noticed that the infant's heart rate was dropping and called in a doctor. At this point, according to court documents, the mother repeated to the doctor that she had Guillain-Barre syndrome and that it needed to be treated before delivery. The doctor allegedly reassured her that it would.

Early the next morning, the mother delivered the infant plaintiff. Three days later, according to the court documents, the mother and the infant were discharged after the infant had allegedly been placed under a yellow light to help treat jaundice. Two days after discharge, the mother noticed that the baby had an orange color and returned to the hospital, when it was discovered that the baby's bilirubin level had risen precipitously. 

The court documents sought a recovery of damages for the losses that were incurred by the plaintiff infant that included those relating to brain damage, developmental delays and other injuries. The case was ultimately settled for an amount of $4,000,000.00 so that the case would not proceed through trial. The case has since been dismissed.
