Law Society Regulatory Proceedings for January 2013

Attention News Editors:

The Law Society of Upper Canada regulates the lawyers and paralegals of Ontario in the public interest. The Law Society ensures that all lawyers and licensed paralegals in Ontario meet standards of learning, professional competence and professional conduct that are appropriate for the legal services provided.

As part of this mandate, the Law Society's Hearing and Appeal Panels recently heard the following matters. Hearing and Appeal Panels are responsible for determining the appropriate disposition of cases.

Charles Ato Amissah-Ocran (1998) of the City of Mississauga

Decision: The Lawyer's licence is suspended for two years, commencing retroactively on December 2, 2010, and continuing indefinitely thereafter until conditions are satisfied. The Lawyer will also be subject to conditions for two years on returning to practise.

Sheldon Benjamin (2004) of the City of Toronto

Decision: The order of July 26, 2011 is varied by terminating the supervision order and varying the costs order.

Roy Francis DMello (1993) of the Town of Oakville

Decision: The hearing panel's December 11, 2012 decision and order suspending the Lawyer for one month is stayed pending the hearing of the appeal, subject to certain conditions.

Howard Sanford Dyment (1978) of the City of Toronto (UNDER APPEAL)

Decision: The Lawyer was suspended for 7 months and ordered to pay money to a client.

Decision: The hearing panel's decision and order suspending the Lawyer and ordering him to pay money to a client is stayed pending appeal.

Charles William Fleming (1979) of the City of London

Decision: The Lawyer was found to be ungovernable and his licence was revoked.

Harvey Howard Hacker (1975) of the City of Toronto

Decision: The Lawyer was granted permission to surrender his licence within 30 days, failing which his licence will be revoked.

Rita Anne Hartmann (1975), of the City Toronto

The Lawyer was found not to have engaged in professional misconduct and the application was dismissed.

Matthew Joseal Igbinosun (1998) of the City of Toronto

Decision: The stay of the hearing panel's decision which is due to expire February 13, 2013 is extended 90 days.

Inis Mani (2010) of the City of Toronto

Decision: The Paralegal was suspended for 30 days.

Said Mohammedally (1996), of the City of Toronto

Decision: The Lawyer is to be reprimanded.

Michael Andrew Osborne (1981) of the City of Toronto

Decision: The hearing panel's November 5, 2012 decision and order suspending the Lawyer is stayed pending the hearing of the appeal on its merits.

Edmund Peterson (1987) of the City of Toronto

Decision: The Lawyer was suspended for 3 months commencing at the conclusion of his current administrative suspensions and continuing indefinitely until a condition is satisfied.

Eugenio Totera (2000), of the Town of Richmond Hill

Decision: A motion brought by the Lawyer, for an order dismissing the Application, was granted.

Michael James Webster (1996), of the City of Toronto

Decision: The lawyer's licence will be revoked, effective three months from December 20, 2012, unless he meets specified conditions. His licence is indefinitely suspended, effective immediately, until he has met specified conditions. A further fixed suspension of six months will start when the indefinite suspension ends, if his licence has not been previously revoked.
