Many people are concerned with the privacy, or lack thereof, that could occur with storing personal documents into a non-physical storage unit. NEW YORK, NY--(Marketwire - February 07, 2013) - The New York medical malpractice attorneys at the law firm of Fitzgerald & Fitzgerald have been representing clients who were injured by substandard medical care for more than 40 years since the firm's inception. The attorneys at the firm handle litigation matters that relate to birth injuries, brain injuries occurring at birth that lead to cerebral palsy diagnoses and several other controversies. The firm hereby announces that it has successfully negotiated a settlement that resolves a birth injury case in which an infant was allegedly harmed by substandard medical care provided by the defendant facility.

Specifically, this New York medical malpractice lawsuit was filed on behalf of a plaintiff infant who was allegedly injured while under the care of the defendant hospital. The case was filed in the Bronx County Supreme Court and it was assigned a case number of A02133. The lawsuit was an effort to recover damages that would compensate the plaintiff and the plaintiff's family for several forms of loss related to the care that the plaintiff would need later in life.

According to court documents, this New York medical malpractice lawsuit arose because the plaintiff infant suffered injuries that included spastic quadraparesis, glaucoma, periventricular leukomalcia and asthma. The court documents also stated that the plaintiff infant was bound to a wheel chair because of the harm suffered during birth. 

The court documents went on to allege that these injuries were suffered after the plaintiff infant's mother gave birth to the plaintiff at 32 weeks of gestation by way of C-section because of placental previa. These same documents described the infant child's birth and the fact that almost immediately after he was born he began to experience breathing difficulties. He was transferred to NICU and placed on a CPAP machine. 

The court documents went on to allege that the plaintiff infant continued to experience extreme breathing difficulties for an additional 90 minutes. At that point, he was intubated by hospital staff. The New York medical malpractice lawyers at Fitzgerald & Fitzgerald alleged in the pleadings that defendant hospital departed from good and accepted medical practice in the care of infant plaintiff in failing to timely administer surfactant and bicarbonate and failing to timely intubate infant plaintiff, both of which ultimately resulted in infant plaintiff sustaining severe and permanent injuries.

Rather than fully litigate this matter, the attorneys representing the infant client and representatives of the defendants met and were able to successfully negotiate an out-of-court settlement in the amount of $2,600,000.00. The case is now considered to be closed by both of the sides involved in the controversy considering the damages paid for losses incurred.
