Lawsuit Seeks Injunction Declaring Requirement to Provide Insurance for Abortions Unconstitutional

TUPELO, Miss., Feb. 20, 2013 /PRNewswire-USNewswire/ -- Today, Liberty Institute and the Center for Religious Expression on behalf of their client, American Family Association (AFA), filed a lawsuit against the federal government's HHS Mandate in the United States District Court for the Northern District of Mississippi, Aberdeen Division. The lawsuit, The American Family Association v. Kathleen Sebelius, Secretary of the United States Department of Health and Human Services, contends that the U.S. Department of Health and Human Services' requirements mandating insurance coverage to its employees, which include provision of abortion-inducing drugs and related educational counseling, unconstitutionally coerces AFA to violate its religious convictions and mission under threat of heavy fines and penalties. Specifically, the HHS Mandate violates the First and Fifth Amendments of the U.S. Constitution, the Religious Freedom Restoration Act, and the Administrative Procedure Act.
